    Your Humble Indie Bundle dollars at work! The Copyright Office is taking submissions about possible new exemptions to the Digital Millennium Copyright Act, and the Electronic Frontier Foundation is petitioning the office to protect "jailbreaking" of consoles, tablets, and other devices to run software other than that supported by the manufacturer. A year ago, a similar EFF initiative resulted in an exemption on "jailbreaking" smartphones.

    "The DMCA is supposed to block copyright infringement," said EFF Intellectual Property Director Corynne McSherry. "But instead it can be misused to threaten creators, innovators, and consumers, discouraging them from making full and fair use of their own property." McSherry asserted that "artists and tinkerers" who want to modify their devices to run whatever they want deserve legal protection.

    The use of jailbroken consoles -- or any technology -- to violate copyright (by, for example, playing an unauthorized copy of a retail game) would remain illegal. But the act of modding a console itself would no longer be.

    The Copyright Office will hold hearings on DMCA extensions in the spring.
    This I can get behind.

    They are looking for something specific to amend consumer rights.

    And in all honesty this will go through for the same reasons the smartphones go through. Lets go EFF!

    Its only logical the same exception afforded smartphone jailbreakers be afforded to jailbreakers of other fixed hardware platforms.

    The actual act of jailbreaking does nothing that shouldn't be afforded protection.

    I donīt quite get it? Modding console is illegal? Since when? I got a store about 4 km away form my home that does modding for a living, the store is in daybroadlight and the store name is modi5.

    1) Ok, what kind of modding? Do they jailbreak your OS for you? If so... Yeah, what they are doing is illegal, even if this exception goes through. The exception only applies to personal use, you still can't distribute or sell software breaking software.

    If this is the modi5 I am thinking of... They aren't actually modding your console, creating customer packages and designs isn't really modding.

    2) The DMCA is the Digital Millennium Copyright Act. Basically it establishes in the US the system of checks and balances on copyrighted work and those who seek to use copyright work. It clearly breaks down what is and is not allowed and where the bounds of all parties are.

    In it there is a big set of verbage regarding the bounds of what the producers of copyrighted material are allowed to do to prevent their source code and media from leaking out. To this there are a series of exceptions to this rule, a couple of the more famous ones are pertaining to smartphones.

    The DMCA basically says that if you want to jailbreak your smartphone's OS, you are allowed to.

    This group is trying to expand this provision to (basically) cover all current fixed hardware platforms.

    While one can argue that this may lead to more hackers on the PSN, the problem is the act of jailbreaking your OS isn't inherently 'wrong.' Its what I would call ethically neutral, and hence shouldn't be forbidden.

    No, theyīre jailbreaking the OS. Yes they sell the stuff if you wanna do it yourself, they take more if you want them to do it. Well, the state doesnīt care since they do annual check up on all stores weather hardware or restaurant. Since they arenīt closed yet and be opened for 3 years I guess is legal.
